CASH BACK REFINANCE PROMOTION
TERMS AND CONDITIONS
1. PROMOTION OVERVIEW
(a) This promotion is conducted by MedX Finance Pty Ltd (Australian Credit Licence No. 555195 ACN 662 078 622) (MedX Finance, we, us, our). MedX Finance holds an Australian Credit Licence and is a member of the Australian Financial Complaints Authority (AFCA), membership number 105146
(b) The promotion is the MedX Finance Cash Back Refinance Promotion (Promotion).
(c) These terms and conditions (Terms) apply to the Promotion and form a binding agreement between each Eligible Applicant and MedX Finance. Information on how to participate and the Cash Back Payment form part of these Terms.
(d) By participating in this Promotion, each Eligible Applicant agrees to be bound by these Terms. Participation into the Promotion is deemed acceptance of these Terms.

2. DEFINITIONS
In these Terms, unless the context otherwise requires:
(a) AFCA means the Australian Financial Complaints Authority (www.afca.org.au, 1800 931 678, GPO Box 3, Melbourne VIC 3001).
(b) Applicant means any individual, company, trust, partnership, self-managed superannuation fund, or other entity that submits a refinance application under this Promotion.
(c) Cash Back Payment means the payment calculated in accordance with clause 6.
(d) Eligible Applicant means an Applicant who meets all of the criteria in clause 4.
(e) Eligible Application means any refinance application that satisfies the requirements under clause 4(a). For the avoidance of doubt, Eligible Application does not include new loan application.
(f) Eligible Loan Amount has the meaning given in clause 5.
(g) Exclusion Period means the twenty-four (24) month period immediately preceding the date of the Applicant’s new refinance application.
(h) Promotion Period has the meaning given in clause 3(a).
(i) Related Entity has the meaning given to “related body corporate” in section 9 of the Corporations Act 2001 (Cth), and includes any entity that is a subsidiary of, holding company of, or under common control with, MedX Finance.
(j) Settlement or Settlement Date means the date on which the refinanced loan funds are disbursed by the incoming lender and the refinanced loan(s) are drawn down.
3. PROMOTION PERIOD
(a) The Promotion commences at 12:00 am (AEST) on 12th April 2026 and closes at 11:59 pm (AEST) on 30 June 2026 (Promotion Period).
(b) To be eligible for the Cash Back Payment, an Eligible Application must be submitted during the Promotion Period and must reach unconditional approval and Settlement within one hundred and twenty (120) days of the close of the Promotion Period (i.e., by no later than 28 October 2026).
(c) MedX Finance reserves the right to extend, shorten, or withdraw the Promotion by giving not less than fourteen (14) days’ written notice, which will be published on the MedX Finance website (www.medxfinance.com.au) and communicated to participating brokers.
(d) Any change to the Promotion Period or these Terms under clause 3(c) will not affect:
(i) applications that have already been submitted before the effective date of the change;
(ii) applications that have already reached Settlement before the effective date of the change; or
(iii) any Cash Back Payment that has already been approved for payment.
4. ELIGIBILITY
(a) The Promotion is open to any Applicant that meets all of the following criteria (an Eligible Applicant):
(i) the Applicant submits a refinance application through a MedX Finance accredited broker or directly through MedX Finance during the Promotion Period;
(ii) the refinance application is for either a home loan or residential investment loan;
(iii) the total Eligible Loan Amount (as defined in clause 5) is a minimum of $500,000;
(iv) the refinance application reaches unconditional approval and settles within the timeframe specified in clause 3(b);
(v) the Applicant has an Australian residential address or registered business address; and
(vi) the specific loan(s) being refinanced under this Promotion were not originally settled through MedX Finance (or any Related Entity) within the Exclusion Period.
(b) For the avoidance of doubt, the Exclusion Period in clause 4(a)(vi) applies only to the specific loan(s) being refinanced under this Promotion. An existing MedX Finance client who has other loans that settled through MedX Finance within the Exclusion Period remains eligible for the Promotion in respect of new lending that was not previously settled through MedX Finance within that period. For example, a commercial client with an existing MedX Finance commercial facility may apply for the Promotion in relation to a residential refinance that was not previously facilitated by MedX Finance.
(c) Each Eligible Application is assessed independently. Where an Eligible Applicant submits multiple separate refinance applications during the Promotion Period, each application will be assessed against these Terms on a standalone basis and if deemed an Eligible Application, will be entitled to a separate Cash Back Payment.
(d) The Promotion is available nationwide across Australia.
(e) Directors, employees, and contractors of MedX Finance and its Related Entities are not eligible to participate in this Promotion unless otherwise approved in writing by a director of MedX Finance.
(f) An Eligible Applicant may withdraw from the Promotion at any time before Settlement by giving written notice to MedX Finance. Withdrawal does not affect the Applicant’s refinance application or any other rights.
5. ELIGIBLE LOAN AMOUNT
(a) The Eligible Loan Amount means the total settled refinance loan amount(s), net of any offset account balance(s) held at the time of Settlement.
(b) For the purposes of calculating the Eligible Loan Amount:
(i) the total loan amount is the aggregate principal balance of all refinanced loans under the relevant application at the Settlement Date;
(ii) any balance(s) held in an offset account linked to any of the refinanced loan(s) at the Settlement Date will be deducted from the total loan amount; and
(iii) the resulting net figure is the Eligible Loan Amount for the purpose of determining the Cash Back Payment under clause 6.
(c) Where an offset account is established after Settlement but before payment of the Cash Back Payment, MedX Finance reserves the right to recalculate the Eligible Loan Amount based on the offset balance as at the Settlement Date. The offset balance at Settlement is determinative.
(d) For the avoidance of doubt, the Eligible Loan Amount is calculated based on the loan and offset balances as they stand at Settlement. Subsequent changes to the loan balance or offset balance after Settlement do not affect the Cash Back Payment calculation.
6. CASH BACK PAYMENT STRUCTURE
(a) Subject to these Terms, the Cash Back Payment is calculated as $500 for each complete $500,000 of Eligible Loan Amount, up to a maximum of $5,000 per application.
(b) For illustrative purposes, the Cash Back Payment tiers are as follows:

(c) Amounts below the minimum $500,000 threshold do not attract any Cash Back Payment. Amounts between tiers are rounded down to the nearest complete $500,000 increment.
(d) The Cash Back Payment is not redeemable for additional products or services and has no alternative form of payment beyond the methods described in clause 7.
(e) The Cash Back Payment amounts specified above are exclusive of GST. MedX Finance will determine whether GST is payable on the Cash Back Payment. If GST is payable, MedX Finance will issue a tax invoice and the total amount paid will be the Cash Back Payment plus any applicable GST. Eligible Applicants should seek their own independent tax advice regarding the tax treatment of the Cash Back Payment.
7. PAYMENT OF CASH BACK
(a) The Cash Back Payment will be made after ninety (90) calendar days of the Settlement Date of the Eligible Application.
(b) Payment will be made by electronic funds transfer (EFT) to a nominated Australian bank account in the Eligible Applicant’s name, credit to the borrower’s loan or offset account, or such other method as MedX Finance and the Eligible Applicant agree in writing.
(c) The Eligible Applicant must provide valid payment details (including BSB, account number, and account name) when requested by MedX Finance.
(d) If an Eligible Applicant fails to claim the Cash Back Payment and provide valid payment details within sixty (60) days of being requested, MedX Finance will issue a further written notice allowing an additional thirty (30) days to provide the details. If valid payment details are still not provided at the end of that further period, MedX Finance may, by written notice to the Eligible Applicant, treat the Cash Back Payment as forfeited. The Eligible Applicant may provide valid payment details at any time before the written forfeiture notice is issued.
(e) Where the Eligible Applicant is a company, trust, or other entity, the Cash Back Payment will be made to the entity (not to individual directors, trustees, or beneficiaries) unless MedX Finance agrees otherwise in writing.
(f) MedX Finance is not liable for any delay in payment caused by incomplete or incorrect payment details provided by the Eligible Applicant, processing delays by financial institutions, or other circumstances outside MedX Finance’s reasonable control.
(g) The Cash Back Payment rights under this Promotion are personal to the Eligible Applicant and are not transferable, assignable or exchangeable.
(h) Eligible Applicants are responsible for ensuring that all their payment details provided are correct. MedX Finance will not be liable for any costs associated with misdirect funds, should the Eligible Applicant provide incorrect payment details.
8. NO CLAWBACK
(a) Once the Cash Back Payment has been made to the Eligible Applicant, it is not subject to clawback, repayment, or recovery by MedX Finance, irrespective of whether the refinanced loan(s) are subsequently discharged, refinanced, or repaid.
(b) For the avoidance of doubt, this clause does not limit MedX Finance’s rights under clause 12 (Fraud and Misrepresentation).
9. BEST INTERESTS DUTY, RESPONSIBLE LENDING AND CREDIT ASSESSMENT
(a) Best interests duty. MedX Finance and its accredited brokers are subject to the best interests duty under section 158LA of the National Consumer Credit Protection Act 2009 (Cth) (NCCP Act). The existence of this Promotion does not alter, diminish, or override the best interests duty. Any credit assistance provided by MedX Finance or an accredited broker in connection with a refinance application under this Promotion is provided independently of the Cash Back Payment and must comply with the best interests duty at all times.
(b) Promotion does not influence suitability. The Cash Back Payment under this Promotion is separate from, and does not form part of, the credit assessment or responsible lending process. The availability of the Cash Back Payment:
(i) must not influence, and must not be taken into account in, any assessment of the suitability or affordability of a refinanced loan;
(ii) must not be a factor in determining whether a particular credit product or lender is in the Applicant’s best interests; and
(iii) does not constitute an inducement to enter into a credit contract that may not be suitable for the Applicant’s requirements and objectives or that the Applicant could not afford.
(c) Credit assistance is provided separately. For the avoidance of doubt, MedX Finance provides credit assistance (within the meaning of section 8 of the NCCP Act) in connection with refinance applications. This Promotion relates solely to a cash back incentive payable upon Settlement and does not itself constitute credit assistance, a recommendation to refinance, or personal financial product advice. The credit assistance provided by MedX Finance or its accredited brokers is governed by the NCCP Act, including the best interests duty (section 158LA), the responsible lending obligations (Part 3-2, Division 3), and the obligation not to suggest unsuitable credit contracts (section 123). Applicants will receive separate disclosure documents in relation to any credit assistance provided.
(d) The Promotion is subject to the Eligible Applicant satisfying all standard lending criteria, credit assessment requirements, and responsible lending obligations as required by the applicable lender and by law, including the NCCP Act.
(e) MedX Finance does not guarantee that any refinance application will be approved. Participation in this Promotion does not constitute a guarantee of credit approval.
(f) Applicants should consider their own financial circumstances and objectives, and may wish to seek independent financial and legal advice, before making any decision to refinance.
10. GENERAL CONDITIONS
(a) The Promotion cannot be used in conjunction with any other MedX Finance offer, promotion, or cash back arrangement unless expressly stated otherwise in writing by MedX Finance.
(b) Lender cash back offers. This Promotion may be received in addition to any separate cash back, rebate, or incentive offer made directly by a lender (Lender Cash Back). The MedX Finance Cash Back Payment and any Lender Cash Back are independent of each other. Eligibility for and payment of a Lender Cash Back is subject to the lender’s own terms and conditions and is a matter between the Applicant and the lender. MedX Finance makes no representations or guarantees regarding the availability, amount, or terms of any Lender Cash Back.
(c) MedX Finance reserves the right to vary, suspend, or terminate the Promotion, or to amend these Terms, by giving not less than fourteen (14) days’ written notice published on the MedX Finance website. Any amendment will not affect:
(i) applications that have been submitted before the effective date of the amendment;
(ii) applications that have reached Settlement before the effective date of the amendment; or
(iii) any Cash Back Payment that has already been approved for payment or paid.
(d) If the Promotion is varied in a way that is materially adverse to an Eligible Applicant whose application has been submitted but has not yet reached Settlement, the Eligible Applicant may withdraw from the Promotion by giving written notice to MedX Finance within fourteen (14) days of the amendment taking effect, without prejudice to the Applicant’s refinance application or any other rights.
(e) Notwithstanding clause 10(c), MedX Finance may immediately vary, suspend, or terminate the Promotion as appropriate and without prior notice if:
(i) required to do so by law, by a direction or requirement of the Australian Securities and Investments Commission (ASIC), AFCA, or any other regulatory authority, or by a court order; or
(ii) if the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reasons beyond MedX Finance’s reasonable control, including but not limited to technical difficulties, unauthorised intervention or fraud.
(f) MedX Finance reserves the right, at any time, to verify the validity of Eligible Applications and Eligible Applicants (including an Eligible Applicant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the MedX Finance has reason to believe has breached any of these Terms, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of thePromotion. Errors and omissions may be accepted at MedX Finance’s discretion. Failure by the MedX Finance to enforce any of its rights at any stage does not constitute a waiver of those rights. The MedX Finance’s legal rights to recover damages or other compensation from such an offender are reserved.
(g) If there is a dispute as to the identity of an Eligible Applicant, the Promoter reserves the right in its sole discretion, to determine the identity of the Eligible Applicant and the individual that will be awarded the Cash Back Payment.
11. BROKER CONDUCT
(a) Where the Promotion is communicated by a broker to a client, the broker is responsible for ensuring that any representations made about the Promotion are accurate, not misleading, and consistent with these Terms.
(b) Best interests duty. Brokers must at all times prioritise the best interests duty under section 158LA of the NCCP Act when providing credit assistance to an Applicant. The existence of the Cash Back Payment must not influence a broker’s recommendation as to the suitability of any credit product or lender for the Applicant. A broker must not recommend a refinance, or a particular credit product, on the basis that the Applicant will receive the Cash Back Payment, if that refinance or product would not otherwise be in the Applicant’s best interests.
(c) No inducement. Brokers must not use the Promotion as an inducement to enter into a credit contract that is unsuitable for the Applicant’s requirements and objectives, or that the Applicant could not afford. Brokers must comply with their own obligations under the NCCP Act (including the best interests duty, responsible lending obligations, and the obligation not to suggest unsuitable credit contracts) and their Australian Credit Licence or Credit Representative authorisation.
(d) MedX Finance is not responsible for any representations made by a broker that are inconsistent with these Terms. If MedX Finance becomes aware that a broker is using the Promotion in a manner that is inconsistent with the best interests duty or responsible lending obligations, MedX Finance may suspend that broker’s participation in the Promotion.
12. FRAUD AND MISREPRESENTATION
(a) MedX Finance reserves the right, acting reasonably, to disqualify any Applicant, refuse to make a Cash Back Payment, or take legal action, where MedX Finance has reasonable grounds to believe that an Applicant has:
(i) engaged in fraudulent conduct in connection with this Promotion;
(ii) made a false or misleading representation to MedX Finance or to a lender in connection with the refinance application;
(iii) artificially structured loan amounts, offset balances, or settlement timing for the purpose of obtaining a Cash Back Payment to which the Applicant would not otherwise be entitled; or
(iv) otherwise manipulated or attempted to manipulate the terms or process of the Promotion.
(b) Before disqualifying an Applicant or refusing to make a Cash Back Payment under this clause, MedX Finance will:
(v) notify the Applicant in writing of the grounds for the proposed disqualification or refusal; and
(vi) give the Applicant fourteen (14) days to respond in writing before a final decision is made.
(c) MedX Finance may recover a Cash Back Payment already made only where MedX Finance establishes, on reasonable grounds, that the payment was obtained by actual fraud or material misrepresentation by the Applicant.
13. TAX
(a) The Cash Back Payment may have tax implications for the Eligible Applicant, including but not limited to income tax and goods and services tax (GST). MedX Finance does not provide tax advice and makes no representations regarding the tax treatment of the Cash Back Payment.
(b) Eligible Applicants are solely responsible for any tax obligations arising from the receipt of the Cash Back Payment and should seek independent tax advice.
(c) If MedX Finance is required by law to withhold any amount from the Cash Back Payment (including under the Taxation Administration Act 1953 (Cth)), MedX Finance will do so and the net payment will constitute full satisfaction of MedX Finance’s obligation under this Promotion. MedX Finance will provide the Eligible Applicant with a written statement of any amount withheld.
(d) MedX Finance may provide information about the Cash Back Payment to the Australian Taxation Office as required by law.
14. PRIVACY
(a) MedX Finance collects personal information in connection with this Promotion for the purposes of:
(i) assessing eligibility for the Cash Back Payment;
(ii) calculating and processing the Cash Back Payment;
(iii) administering and managing the Promotion, including verifying compliance with these Terms;
(iv) complying with legal and regulatory obligations; and
(v) contacting the Eligible Applicant about the Promotion.
(b) The types of personal information collected may include the Applicant’s name, contact details, loan details, offset account balances, settlement information, and bank account details for payment.
(c) MedX Finance may disclose personal information to its Related Entities, accredited brokers, lenders, payment processors, professional advisors, and regulatory authorities, to the extent necessary for the purposes described in clause 14(a).
(d) If the Applicant does not provide the personal information requested, MedX Finance may not be able to assess the Applicant’s eligibility for or process the Cash Back Payment.
(e) Personal information is handled in accordance with MedX Finance’s Privacy Policy, available at https://www.medxfinance.com.au/privacy-policy, and in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. The Privacy Policy sets out how the Applicant can access and correct their personal information, and how to make a privacy complaint.
(f) MedX Finance does not intend to disclose personal information to overseas recipients in connection with this Promotion. If this changes, MedX Finance will update its Privacy Policy accordingly.
15. LIABILITY
(a) To the maximum extent permitted by law, MedX Finance (including its respective officers, employees and agents) is not responsible for and excludes liability (including negligence) for any personal injury; or loss or damage (including loss of opportunity; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is lost, late, altered, damaged or misdirected (whether or not after their receipt by MedX Finance); (d) any variation in reward value to that stated in the Terms and Conditions; (f) any tax liability incurred by an Eligible Applicant; or (g) use of the Cash Back Payment.
(b) Nothing in these Terms limits, excludes, restricts or modifies, or purports to limit, exclude, restrict, or modify:
(i) any consumer guarantee or right under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth));
(ii) any other implied warranties under the Australian Securities and Investments Commission Act 2001 (Cth); or
(iii) any other right or remedy under any applicable legislation in the States and Territories of Australia which cannot be excluded, restricted, or modified by agreement.
(collectively referred to as the Non-Excludable Guarantees)
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, MedX Finance (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
16. DISPUTES AND COMPLAINTS
(a) If an Eligible Applicant has a complaint or dispute about this Promotion, they should first contact MedX Finance directly:

(b) MedX Finance will acknowledge the complaint within one (1) business day (or as soon as practicable) and will endeavour to resolve the complaint within thirty (30) calendar days in accordance with its internal dispute resolution (IDR) procedures and ASIC Regulatory Guide 271 (Internal Dispute Resolution).
(c) If the complaint is not resolved to the Eligible Applicant’s satisfaction through MedX Finance’s IDR process, or if MedX Finance has not responded within the required timeframe, the Eligible Applicant may lodge a complaint with the Australian Financial Complaints Authority (AFCA):

(d) AFCA provides a free and independent dispute resolution service. Time limits may apply to lodge a complaint with AFCA, so the Eligible Applicant should act promptly.
(e) MedX Finance’s decision is final and no correspondence will be entered into.
17. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of the State of New South Wales and the parties submit to the non-exclusive jurisdiction of the courts of that State and the federal courts of Australia.
18. INTERPRETATION
(a) In these Terms, unless the context otherwise requires:
(i) headings are for convenience only and do not affect interpretation;
(ii) words in the singular include the plural and vice versa;
(iii) a reference to legislation includes any amendment, re-enactment, or replacement of that legislation and any subordinate legislation made under it;
(iv) monetary amounts are in Australian dollars (AUD) unless otherwise specified;
(v) a reference to a party includes that party’s successors and permitted assigns; and
(vi) where any word or phrase is defined, other grammatical forms of that word or phrase have corresponding meanings.
19. SEVERABILITY
If any provision of these Terms is found to be void, unenforceable, or invalid (including under the unfair contract terms provisions of the Australian Consumer Law), that provision will be severed from these Terms to the extent of the invalidity without affecting the validity or enforceability of the remaining provisions, which will continue in full force and effect.
20. ENTIRE AGREEMENT
These Terms constitute the entire agreement between MedX Finance and the Eligible Applicant in relation to the Promotion and supersede all prior representations, communications, and agreements (whether oral or written) in relation to the Promotion. For the avoidance of doubt, these Terms do not affect the terms and conditions of any credit contract or loan agreement entered into by the Applicant.
